Real Estate Law has always been a major practice area at Baker Newby LLP. Our real estate practice deals extensively with commercial property transactions and financing. The purchase of commercial property involves complex legal matters including the obtaining of warranties and representations and environmental considerations. Securing commercial loans with real estate requires special knowledge regarding such items as covenants and guarantees, collateral security, corporate documentation and banking procedures. We can attend to all such matters. We also deal with all aspects of residential conveyancing and mortgage lending at competitive prices.

Property development is an important part of our real estate practice. We act for clients who are developing their property for either residential or commercial purposes and assist them in planning their development, assembling parcels of land, obtaining municipal approvals, subdividing their land and dealing with the Land Title Office. We also attend to preparing and filing Disclosure Statements where the development requires such a filing with the Superintendent of Real Estate.

We have extensive experience in dealing with matters covered by the Strata Property Act. This could involve acting on phased strata title developments or bare land strata subdivisions, advising Strata Corporations, drafting or reviewing strata by-laws or assisting in disputes between owners and strata corporations.

We also act for clients involved in all other types of property transactions including options to purchase, rights of first refusal to purchase, easements, rights-of-way, building schemes and restrictive covenants. Our many years of dealing with municipalities also allows us to assist clients in Municipal Law matters involving zoning, building and subdivision bylaws, statutory rights-of-way and Land Title Act section 219 covenants. We have also had considerable experience dealing with the expropriation of land – this is an area of law with special procedures and considerations and in which we can help ensure that our clients are dealt with fairly.
