When a will is prepared, the vast majority of the time it is done so with kindness and careful consideration. Unfortunately, some wills may deal with an estate in a manner that is unfair to those persons that the deceased owes obligations to. This may have been done intentionally, or accidentally.
In an estates practice, there are a few main areas that arise and may lead to estate litigation. Those areas are as follows:
- A wills variation action;
- A joint tenancy dispute;
- An intestate deceased (when there is no will); and
- Validity of a will.
